Diante dessa situa\u00e7\u00e3o, o distrato, isto \u00e9, a desist\u00eancia, passou a ser a melhor op\u00e7\u00e3o para quem n\u00e3o quer continuar com a compra do im\u00f3vel.<\/p>\n<p>O posicionamento dos Tribunais de Justi\u00e7a passou a ser un\u00edssono no sentido de que \u00e9 abusiva e ilegal a cl\u00e1usula do distrato decorrente de compra e venda imobili\u00e1ria que prev\u00ea a reten\u00e7\u00e3o integral ou a devolu\u00e7\u00e3o \u00ednfima das parcelas pagas pelo promitente comprador.<\/p>\n<p>Sendo assim, somente podem ser retidos pela compromiss\u00e1ria-vendedora os valores suficientes para indenizar esta pelos custos administrativos, como despesas de comercializa\u00e7\u00e3o, tributos e eventual utiliza\u00e7\u00e3o do im\u00f3vel, oriundos do desfazimento da contrata\u00e7\u00e3o. Deduzidos tais custos, o restante do valor pago deve ser devolvido ao comprador.<\/p>\n<p>Nesta medida, o E. Superior Tribunal de Justi\u00e7a sedimentou como adequado a t\u00edtulo de reten\u00e7\u00e3o pelo vendedor os percentuais m\u00ednimo de 10% e m\u00e1ximo de 25%, conforme as circunst\u00e2ncias de cada caso. height=&#8221;12px&#8221;][vc_column_text]O atraso na entrega de im\u00f3vel comprado na planta, computando-se a cl\u00e1usula de toler\u00e2ncia, d\u00e1 ao consumidor o direito de receber indeniza\u00e7\u00e3o por danos materiais e morais.<\/p>\n<p>Isso porque, cada vez mais se sedimenta o entendimento de que argumentos como (i) embara\u00e7os criados pela Prefeitura Municipal para expedi\u00e7\u00e3o de habite-se, (ii) outros entraves administrativos, (iii) problemas clim\u00e1ticos, ou ainda (iv) custo de materiais ou de m\u00e3o-de-obra n\u00e3o tem sido admitidos, visto que s\u00e3o fatos previs\u00edveis que integram o risco do empreendimento e consubstanciam fortuito interno, n\u00e3o sendo capazes de justificar a mora na entrega do im\u00f3vel adquirido na Servi\u00e7o) vem resistindo \u00e0 utiliza\u00e7\u00e3o do saldo existente nas contas vinculadas ao FGTS pelos mutu\u00e1rios no \u00e2mbito do Sistema Financeiro Imobili\u00e1rio, por\u00e9m, fundamentando-se na finalidade social do FGTS, temos conseguido a libera\u00e7\u00e3o dos valores para a quita\u00e7\u00e3o do saldo remanescente, com a utiliza\u00e7\u00e3o do FGTS.<\/p>\n<p>Neste sentido estamos trabalhando para a obten\u00e7\u00e3o da libera\u00e7\u00e3o dos saldos existentes nas contas vinculadas ao Fundo de Garantia por Tempo de Servi\u00e7o para a quita\u00e7\u00e3o ou amortiza\u00e7\u00e3o dos financiamentos imobili\u00e1rios no \u00e2mbito do SFH, como tamb\u00e9m no \u00e2mbito do Sistema Financeiro Imobili\u00e1rio, inclusive em sede de tutela de inadimpl\u00eancia, os agentes financeiros n\u00e3o precisam mais de a\u00e7\u00e3o judicial para retomar o im\u00f3vel e revend\u00ea-lo por meio de leil\u00e3o, de modo que tudo ocorre de forma extrajudicial e r\u00e1pida, diferente do que ocorre em uma execu\u00e7\u00e3o de garantia hipotec\u00e1ria.<\/p>\n<p>Acontece que o comprador do im\u00f3vel que deixa de pagar as parcelas do financiamento imobili\u00e1rio, normalmente tr\u00eas parcelas consecutivas, acaba ignorando a notifica\u00e7\u00e3o enviada pelo banco, por meio de cart\u00f3rio de im\u00f3veis, para o pagamento da d\u00edvida, achando que \u00e9 simplesmente uma carta de cobran\u00e7a e imaginando que, ap\u00f3s o prazo da notifica\u00e7\u00e3o, ainda conseguir\u00e1 renegociar a d\u00edvida.<\/p>\n<p>Todavia, passados os dias para pagamento volunt\u00e1rio estabelecidos na notifica\u00e7\u00e3o, as institui\u00e7\u00f5es financeiras geralmente rejeitam qualquer pagamento, mesmo que o comprador tenha o dinheiro para quitar toda a d\u00edvida, alegando que consolidaram a propriedade, ou seja, retomaram o im\u00f3vel, passando o im\u00f3vel para o seu nome.<\/p>\n<p>Nestes casos buscamos a solu\u00e7\u00e3o judicial, \u00fanica alternativa para evitar o leil\u00e3o (via liminar, com urg\u00eancia) para evitar a perda do im\u00f3vel.[\/vc_column_text][vc_empty_space
